RadarOnline.com has learned that the four-year-old twins are in very serious danger of being placed in foster care, after Child Protective Services was presented with mystery evidence revealing major inconsistencies in Mueller’s drug treatment program.
“There is a very real possibility that Bob and Max could be placed in foster case because evidence was also uncovered regarding their temporary guardian, Scott, that is riddled with glaring differences in version of events,” a source close to the situation tells Radar exclusively. “The department is taking this very seriously, and are considering recommending the boys be placed in foster care, pending the outcome of the investigation.”
“Charlie can’t get custody of the boys, even if he were to have round the clock nannies because of his past behavior,” the source explains. “Brooke’s parents won’t be considered. It’s such a sad situation, but the safety and well-being of the boys comes first. Such drastic action wouldn’t be taken unless it was necessary, and sadly, it is.”The boys had been on track to be placed back in their mother’s care by Christmas.
Mueller’s brother, Scott, was recently granted temporary guardianship of the boys, after Denise Richards was forced to give them up because of their violent outbursts towards her daughters, Sam, Lola, Eloise, and the family pets.
Last summer, Brooke lost custody of the boys after being placed on an involuntary psychiatric hold stemming from a drug overdose.
Now, the Los Angeles County of Department of Children & Family Services is set to go before a judge in child dependency court on Thursday, requesting an administrative hearing to be scheduled based on the new information presented to the agency. Mueller is required to be in court on Thursday, and sources say Sheen isn’t expected to attend.

Social workers were impressed with Denise’s commitment to the boys. If the boys were to come back to Denise, she said they would have to be properly tested and assessed for their behavioral issues. She never wanted to give the boys up, but Brooke refused to allow them to be seen by doctors,” a source close to the situation told Radar.

In a distressing letter to child protective services, Richards explained why she had to give up temporary guardianship of the boys.
According to Richards, her “daughters have been strangled, kicked in the head and stomach, scratched, bit, slapped, punched in the face and head, and spit on” by the boys, as have the family dogs. One night, she claims, they even broke into their baby sister ‘s room and relieved themselves in her tub, flinging their feces all over her bathroom. Richards has battled to have the boys evaluated for such unimaginable acts, but says that she has been stymied at every turn by Mueller.

Meanwhile, DCFS can go to court “at anytime and ask the judge to strip Scott Mueller of temporary guardianship, and placed in foster care. It’s a very, very real possibility. Charlie Sheen has hit out at his ex-wife Denise Richards after reportedly discovering he will not be spending Christmas with his daughters.
Sheen is said to have been planning to join his former partner and their two daughters, Sam, 9, and Lola, 8, over the holidays, but sources tell TMZ.com Richards has pulled the plug on the plans.
The actor has now taken to his Twitter.com account to vent his fury at Richards, posting a picture of a baseball bat given to the couple as a wedding souvenir chopped into pieces, with the caption, “The lie is over. I’m done being treated like a relative with a one-way ticket… DuhNeese.”

Reports suggest Sheen will also spend the holidays apart from the twin sons he shares with Brooke Mueller.
The 4-year-old boys, Max and Bob, will be with their temporary guardian, Mueller’s brother Scott, while the former couple’s custody battle continues.
